a) General principles
We will collect, process and use any personal data you may choose to make available to us for no other purpose than the purposes we communicated to you. We may collect, process and use your personal data without your express consent only where

As regards your use of our website the type of personal data we collect, process and use, and the scope and purpose for our doing so (hereinafter “data”), depends on whether you use our websites to access “publicly available information” (see below at a) or “non-public information and services” (see below at b + c).

b) Using our website to access publicly available information
If you enter the websites maintained by NetConnect Germany GmbH & Co. KG for the purpose of accessing publicly available information, i.e. any such information as may be accessed by any user without the need to register or be admitted for this purpose, you are generally free to do so without disclosing any of your data (other than your computer's IP address). For this type of access to our website we automatically collect and use only such data as are submitted to us by your web browser, namely:
-    date and time of your access to any of our websites
-    name of the file accessed
-    data volumes transmitted and information as to whether the file was successfully loaded
-    description of the type of browser you use
-    last page visited

-    your IP address.

We will analyse and evaluate the above information for internal company and statistical purposes (e.g. access frequency, rising level of page views [high traffic volumes], error analyses etc) but without establishing the identity of the individual user. Your IP address will be deleted after you leave our website. We do not collect any further data for this type of use of our website. It remains solely for you to decide whether to submit any further data to us, for example in the course of a survey or in connection with the performance of a contract.

c) Using our website to access non-public information and services
If and to the extent that you wish to access any of the non-public information and services provided on any of our websites, i.e. any such information and services as are only available through the Market Partner Web Portal or the Portal for the Use of the Virtual Trading Point, you will be required to submit to us the data listed above at a) in a non-anonymous form, and any such data as may be required for the purpose of performing the contract, particularly data used for your identification, for performance of the service or for the technical administration of the services offered (e.g. name, business address and email address).
In addition, we will record all such activities performed by you while using the Market Partner Web Portal or the Portal for the Use of the Virtual Trading Point (“log data”) which result in your editing of the information and data held by us on the portals. This logging activity is carried out for the exclusive purpose of detecting any user behaviour that would constitute a breach of contract (e.g. wilful or grossly negligent uploading of erroneous information). If you are a user of the Market Partner Web Portal or of the Portal for the Use of the Virtual Trading Point provided by us, we will store your name, your username, your business email address and your log data for a reasonable period of time after expiry of the relevant Portal User Agreement for the purpose of detecting any user behaviour that would constitute a breach of contract.

3. Cookies

For the purpose of maintaining our website we use so-called cookies, which are small files that are placed on your computer when you visit our website and stored on your computer for their later retrieval. The cookies used by us serve to identify your computer when you next visit our website and when you navigate between different websites of our web presence as well as to store login information for the duration of your use of the web portals. You can adjust the settings of your browser and in doing so decide whether to accept the installation of cookies for your use of the NCG website.
